INTRODUCTION

These General terms and conditions of use were most recently updated on 12 December 2018.

By using the Site, or by submitting or considering Opinions, you agree to these General terms and conditions of use.

You are agreeing to such General terms and conditions of use with Automobiles Citroën as a result.

The Site is directed to people residing in the United Kingdom. Automobiles Citroën does not represent that content available on or through the Site is appropriate for use in other locations.

If you do not agree to these General terms and conditions of use, you must not use the Site nor submit any Opinions.

Automobiles Citroën does not charge you for accessing the Site (but please note that you may incur charges from your network connectivity provider for internet or mobile data access).

You should print a copy of these terms for future reference.

ARTICLE 1 - DEFINITIONS

The following terms which start with a capital letter shall have the following meanings:

“Automobiles Citroën”: a public limited company with a capital of 159,000,000 euros, whose registered office is at 7 rue Henri Sainte-Claire Deville Rueil-Malmaison (92500), listed on the Paris Trade and Companies Register under number B 642 050 199.

“Customer experience”: purchase of a Vehicle or of a workshop service in a Dealership.

“Dealership”: Citroën dealership participating in Automobiles Citroën’s online consumer review process.

“Sales Person”: an employee of a Dealership who has sold a New Vehicle or Used Vehicle (Citroën Select) at a Dealership who wished to participate in the process of Automobiles Citroën to collect and publish the review on the website.

“Citroën Advisor Sales Person”: concerns the Reviews about the experience of a Dealership’s Sales Person at the time they purchase of a New Vehicle or Used Vehicle (Citroën Select).

“General terms and conditions of use”: these general terms and conditions of use of the Site.

“Moderator”: Automobiles Citroën’s service provider, responsible for moderation of Reviews and Ratings.

“Opinion”: collectively a Review and any associated Rating in respect of that Review. “PSA Peugeot Citroën Group”: Peugeot Citroën Automobiles UK Ltd, Peugeot Motor Company PLC, Citroen UK Limited, Automobiles Citroën, together with any holding companies, subsidiaries, group companies or affiliated companies of the afore-mentioned companies.

“Rating”: rating allocated by the author of a Review when submitting their Review, either on: the quality of service of the Dealership when purchasing a Vehicle or for a workshop service; or the Vehicle.

“Review”: opinion of a retail consumer customer on: the quality of service of the respective Dealership when purchasing a Vehicle or for workshop services; or the Vehicle.

“Site”: the website accessible at the address www.citroen-advisor.co.uk.

“User”: individual consumer accessing the Site.

“Vehicle”: new vehicle of the Citroën brand.

ARTICLE 2 – PUBLICATION

The Site is published by Automobiles Citroën, a public limited company with a capital of 159,000,000 euros, whose registered office is at 7 rue Henri Sainte-Claire Deville Rueil-Malmaison (92500), listed on the Paris Trade and Companies Register under number B 642 050 199.

The Reviews and Ratings may also be published on, and be accessible from, other websites of the PSA Peugeot Citroën Group, as well as on associated mobile applications of the PSA Peugeot Citroën Group. You confirm your consent to your Reviews and Ratings being published and accessible in this manner.

ARTICLE 3 - COLLECTION OF REVIEWS

3.1 Review

You can go to the Site or to the Dealership’s website (accessible from the address //www.citroen.co.uk/find-a-dealer). On either of these websites, you can see the average Rating received by the Dealership in terms of quality of service, the number of Reviews it has, as well as the average Rating received by a Vehicle and the number of Reviews it has. To find out more about the Reviews or to submit your own Review, you have to click on the “To find out more” link which will redirect you to the Site.

Once the home page of the Site is displayed, you can consult the Reviews on the Dealership in question and/or on the Vehicles.

To submit a Review, you must complete the following steps:

    - Step 1 : you must allocate a Rating to the Dealership or to the Vehicle by hovering over the stars shown, then clicking to confirm the Rating. The stars have the following meaning:
  • 1 star : Very poor
  • 2 stars : Poor
  • 3 stars : Medium
  • 4 stars : Good
  • 5 stars : Very good
  • You must then submit your feedback comment and click "View" to go to the next step.

- Step 2 : You must fill in the following mandatory fields:

  • First name (please note that your first name will be displayed on the Site with the Opinion)
  • Surname(please note that only the initial of your surname will be displayed on the Site with the Opinion)
  • Email Address (this will not be displayed on the Site with the Opinion)
  • Brand/Model/Vehicle body type (this will be displayed on the Site with the Opinion)
  • Registration number of the vehicle (this will not be displayed on the Site with the Opinion)
  • Date of Customer Experience (this may be displayed on the Site with the Opinion)
  • Postcode (this will be requested only in the case of a Review concerning the quality of a workshop service, but it will not be displayed on the Site with the Opinion)

Please note that your information referred to above which may be displayed on the Site, may also appear on, or be accessible on or from, other websites or mobile applications, as referred to in article 2 above.

To confirm your Opinion, you must accept the General terms and conditions of use and click on “Validate” (please note, that this is in addition to your previous acceptance of the General terms and conditions of use for your use of the Site, which you will have accepted by conduct by using the Site). You will then receive an email from Automobiles Citroën, in order to validate the email address entered. This email will include a link on which you must click in order to validate your email address. Once the email address is validated, the Review will be sent to the Moderator for moderation in accordance with the principles indicated in article 4 below (however, please note that not all Opinions will be necessarily moderated, and therefore you must ensure that your Opinion is submitted in accordance with the requirements of these General terms and conditions of use, including article 3.3 below). You will be informed by email of the publication or otherwise of your Opinion.

Except as mentioned in article 3.2 below, only 1 Opinion per Customer experience can be published.

3.2 Requested Reviews

You may also be requested to submit an Opinion by Automobiles Citroën. An email may be sent to you within 30 days of each Customer experience, inviting you to submit your Opinion on the quality of service of the Dealership on that occasion or on the Vehicle. This email will contain a link to the Site, valid for 30 days from the date of the Customer experience. To submit your Review, you must follow the steps described in article 3.1 above and accept the General terms and conditions of use.

As mentioned above, only 1 Opinion per Customer experience can be published, unless you decide to submit a 2nd Opinion in accordance with the provisions of the section below.

Automobiles Citroën may contact you again to ask if you would like to submit a 2nd Opinion. In this case, you will have the choice between 2 options: submit a 2nd Opinion, which will be published under your 1st Opinion, or submit a 2nd Opinion which cancels and replaces the 1st Opinion.

You may at any time withdraw your consent to be contacted for the purposes of providing Opinions which are requested in this manner, by contacting Automobiles Citroën in writing or by email, using the contact details shown in article 2 above.

Citroën Advisor Sales Person:

The User may be asked by Automobiles Citroën to submit a review. An email will be sent to the User within 45 days of purchase date of their New Vehicle or Used Vehicle (Citroën Select), inviting them to submit an Review based on their experience of the Sales Person. This email contains a link to the website, valid for 30 days from the date of the sending. To submit a review, the User must follow steps 1 and 2 described in article 3.1 c) above and accept the Website Terms of Use.

Only one (1) review per purchase of a New Vehicle or Used Vehicle (Citroën Select) may be published, unless the author decides to file a second notice in accordance with the provisions of the paragraph below.

Automobiles Citroën can re-contact the author of the review to ask him if they wish to file a second review. In this case, the author will have the choice of 2 options: submit a second review with the Associated Note, which will be published under their first review or submit a second review with the Associated Note which cancels and replaces the first review and the first note.

3.3 Author’s Declaration on the Review

By submitting your online Opinion, you confirm that you:

  • are at least 18 years of age;
  • are using the Site in the United Kingdom;
  • accept being contacted by Automobiles Citroën and/or the Moderator if necessary for identification purposes and to discuss your Opinion, and by the Dealership if necessary to discuss your Opinion;
  • have no conflict of interest, that is to say that you have neither an interest in the Dealership nor in Automobiles Citroën (employees of Dealerships, Automobiles Citroën and the PSA Peugeot Citroën Group are excluded from this ‘conflict of interest’ provision in respect of their Opinion);
  • have personally experienced the Customer experience;
  • are submitting a true and accurate Opinion;
  • are not submitting anything by way of your Opinion which would be unlawful, infringing, offensive, derogatory or defamatory (this does not mean that you cannot leave negative Reviews and poor Ratings, but just that where you do, these must be written reasonably, appropriately and lawfully);
  • are not submitting anything which would fall within the examples shown in article 4 below as grounds for rejection of Opinions by the Moderator;
  • accept responsibility and liability for the content, style and tone of your Opinion (taking into account that all Opinions may not be necessarily moderated before publication);
  • allow re-publication of your Opinion in the manner envisaged by these General terms and conditions of use, and you irrevocably waive the exercise of any moral rights in respect of your Opinion;
  • are granting Automobiles Citroën an irrevocable, perpetual, royalty free licence to use, modify and publish the Opinion and sublicense the same to third parties as envisaged by the General terms and conditions of use;
  • agree that your Opinion is non-confidential and non-proprietary;
  • agree that Automobiles Citroën has the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to the Site constitutes a violation of their intellectual property rights or of their right to privacy, or is unlawful..

 

3.4 Data retained by Automobiles Citroën

In order to confirm the authenticity of Customer experiences and the identity of the authors of Opinions, Automobiles Citroën records the IP address, the email address, the first name and surname, the Vehicle registration, the date and time of the submission of Opinions as well as the date and time of the email validation in the case of Reviews, in keeping with the duration for keeping data declared to the CNIL (which is an independent French administrative regulatory body that exercises its functions with regard to the French Data Protection Act). This data is encrypted in Automobiles Citroën’s database.

You confirm that you consent to the above data recording activities.

ARTICLE 4 – MODERATION

The Opinions as well as the responses from Dealerships and Automobiles Citroën may be subject to prior human moderation; that is to say, before their publication on the Site, the Moderator may assess the Opinions and the responses from Dealerships and Automobiles Citroën in order to decide whether to publish them or not. In this capacity, the Moderator can access information relating to the identity of the author of the Opinion to, where appropriate, contact the author to discuss the Opinion.

The timescale for moderation is identical for all Opinions, whether they are positive or negative.

The aim of this moderation is to seek to ensure that the Opinions and the responses from Dealerships and Automobiles Citroën conform to the General terms and conditions of use. If there is a non-conformity which comes to the Moderator’s attention, the Opinions, together with the associated responses from Dealerships and Automobiles Citroën will not be published (or will be removed from the Site, if such non-compliance comes to Automobiles Citroën’s or the Moderator’s attention after publication on the Site). Consequently, the moderation is one of the safeguards which Automobiles Citroën has put in place, but it is not a ‘fail-safe’ protection or confirmation that the Opinions and responses on the Site are accurate or compliant with the General terms and conditions of use and legal requirements. Therefore: you must continue to comply with the General terms and conditions of use (including article 3.3 above) and legal requirements; and you accept full responsibility and liability for anything which you submit by way of any Opinion.

Rejections by the Moderator :

Your Reviews, together with the responses from Dealerships and Automobiles Citroën, may be rejected by the Moderator if they (the following are just examples, and Automobiles Citroën and the Moderator may also reject Reviews and responses for any other reasons, as determined by them in their sole discretion):

  • are unlawful, contain remarks which are improper, abusive, libellous, threatening, obscene, or infringe the intellectual property right of a third-party (other named brand, etc.);
  • contain information related to private life (naming of third parties without their explicit approval, comments on physical appearance or personality, etc.) or confidential information (telephone numbers, addresses, email addresses, VIN, registration number, customer folder number, bank details, etc.) or mention websites, hypertext links, URLs;
  • concern anything other than the quality of service of the Dealership during the purchase of a Vehicle or of workshop services, or a Vehicle (examples of rejection would therefore include information provided in respect of: documentation, warranty policy, etc.);
  • are incomprehensible (series of words with no meaning, poorly written content to the point of being unintelligible, written in a language other than English);
  • contain figures (amount or percentage) relating to the commercial arrangements of the Dealership or of Automobiles Citroën (discount, trade-in, invoice, discounted prices, etc.);
  • include a summons to legal proceedings or contain comments which could incur the civil or criminal liability for the Dealership or Automobiles Citroën;
  • contain a Review which is not consistent with the Rating given (or vice-versa), or which is not compatible with the Vehicle or the service concerned (examples of rejection: purchase of a Vehicle whereas the subject is a workshop repair and vice versa, comment on vehicles other than that concerned, etc.);
  • concern or mention a Dealership other than that which sold the Vehicle or which performed the workshop service (examples of rejection: a comparison between Dealerships or with vehicles of a brand other than Citroën, etc.);
  • contain elements of a conflict of interest (employees of Dealerships, Automobiles Citroën and the PSA Peugeot Citroën Group are excluded in respect of the conflict of interest prohibition);
  • are posted by business customers (only Opinions from consumer customers rather than business customers are permitted);
  • concern a User who has provided identification information which is incorrect or which does not conform to these General terms and conditions of use or who has not personally experienced the Customer experience;
  • represent a duplicate (same author and same Customer experience).

In the event of a rejection for one of the aforementioned reasons, the author of the Opinion or the Dealership or Automobiles Citroën, depending on the case, will be advised of this by email. If required, the author of the Opinion and/or the Dealership and/or Automobiles Citroën will have the chance to submit a new Review or new response within a timescale of 30 calendar days from the date of the Customer experience.

Automobiles Citroën and the Moderator also reserve the right to reasonably censor or modify Reviews and responses (rather than simply rejecting them), where there is apparent non-compliance with the General terms and conditions of use or legal requirements. However, this again does not remove nor reduce your responsibility and liability for complying with the General terms and conditions of use or legal requirements.

Citroën Advisor Sales Person

Your Reviews, together with the responses from Dealerships and Automobiles Citroën, may be rejected by the Moderator if they (the following are just examples, and Automobiles Citroën and the Moderator may also reject Reviews and responses for any other reasons, as determined by them in their sole discretion):

  • are unlawful, contain remarks which are improper, abusive, libellous, threatening, obscene, or infringe the intellectual property right of a third-party (other named brand, etc.);
  • contain information related to private life (naming of third parties without their explicit approval, comments on physical appearance or personality, etc.) or confidential information (telephone numbers, addresses, email addresses, VIN, registration number, customer folder number, bank details, etc.) or mention websites, hypertext links, URLs;
  • concern other than the evaluation of the Sales Person’s service when buying a New Vehicle, a Used Vehicle (Citroën Select);
  • are incomprehensible (series of words with no meaning, poorly written content to the point of being unintelligible, written in a language other than English);
  • contain quantified data (amount or percentage) on the commercial policy of the Dealer or Citroën Automobiles (delivery, return, invoice, discounted rates, etc.);
  • include a call for legal action or contain remarks that may involve the civil or criminal liability of the Dealer or Citroën Automobiles;
  • contain a comment inconsistent with the rating assigned or inconsistent with the Sales Person’s rating (examples of rejection: evaluation of a Sales Person when it is a workshop experience ...);
  • concern a Sales Person who has not made the sale;
  • contain specific elements of conflict of interest (the employees of the Sales Outlets, Automobiles Citroën and the PSA Group are excluded);
  • are completed by professionals (only the reviews of persons who do not have the status of professionals are admitted);
  • relate to a User who has provided incorrect identification information or has not personally experienced the Customer Experience;
  • duplicate (same author and same customer experience);
  • relate to a User who has provided information that does not conform to these Terms of Use (eg: more than 75 days’ notice as a result of the Customer Experience);
  • concern a salesman who is no longer part of the staff of the Dealer or who no longer adheres to the Sales Person Advisor Program

In the event of rejection for one of the reasons mentioned above, the author of the Review or the Dealership or the Sales Person, as case may be, will be informed by email. If applicable, the author of the Review and/or the Dealer and/or the Sales Person will have the opportunity to submit a new Review within 75 calendar days (Citroën Advisor Service) or 120 days (Citroën Advisor Vehicle) or 60 days (Citroën Advisor Sales Person) as of the date of the Customer Experience.

ARTICLE 5 - PRESENTATION AND PUBLICATION OF OPINIONS

5.1 – Presentation of Opinions

Any Reviews which are published on the Site will usually appear for a period of up to one year following their publication date (unless they are removed in accordance with the provisions of these General terms and conditions of use).

Reviews will be published on the Site, by default from the most recent to the oldest, within 30 calendar days following the submission date of the Review (subject to the rejection terms referred to in these General terms and conditions of use). The submission date of the Review, the date of the Customer experience, the first name and surname initial of the author of the Review, the Vehicle model and the Rating given to the Dealership or the Vehicle will be published next to the Review. Reviews published in this way may be sorted by submission date, Rating or usefulness of the Review.

The number of Reviews and the average star rating concerning a Sales Person are posted on other websites of the PSA Group notably of the type //www.citroen.co.uk/and the associated mobile applications.

Provisions common to Citroën Advisor Service, Citroën Advisor Vehicle and Citroën Advisor Sales Person. Advisor Service, Vehicles and SalesPerson will be posted in their entirety on the website, by default from the most recent to the oldest, within a maximum period of 30 (thirty) calendar days from the date of review completion. The date of submission of the review, the date of the Customer Experience, the first and last name of the name of the Sales Person, the model of the

Vehicle and the Rating assigned to the Dealership or Vehicle or the Sales Person is published next to the rating.

The number of Reviews and the average Rating concerning a Dealership will also be displayed on the website of the Dealership in question, accessible from the address //www.citroen.co.uk/find-a-dealer. However, the detail of the Ratings as well as the content of the Reviews will only be able to be consulted on the page of the Site dedicated to the Reviews of the Dealership concerned.

The number of Reviews and the average Rating concerning a Vehicle may also be displayed on other websites of the PSA Peugeot Citroën Group, such as www.citroen.co.uk and the associated mobile applications.

The average Rating is accompanied by the total number of Reviews which are combined and calculated as follows:

    • Average from 1 to 1,24 = 1 stars
    • Average from 1,25 to 1,74 = 1.5 stars
    • Average from 1,75 to 2,24 = 2 stars
    • Average from 2,25 to 2,74 = 2.5 stars
    • Average from 2,75 to 3,24 = 3 stars
    • Average from 3,25 to 3,74 = 3.5 stars
    • Average from 3,75 to 4,24 = 4 stars
    • Average from 4,25 to 4,74 = 4.5 stars
    • Average from 4,75 to 5.0 = 5 stars

 

5.2 – Reporting abuse

Any person may report to Automobiles Citroën that an Review or a response from a Dealership or Automobiles Citroën contains abusive content by clicking on the “Report abuse” link present on the Site. They then just need to complete the online form, providing their first name, surname and email address as well as the reason for their request to delete the Review or the response from a Dealership or Automobiles Citroën. Any such submissions by you, reporting abuse, must be made in good faith and reasonably, otherwise (without affecting Automobiles Citroën’s additional rights and remedies against you) you agree to reimburse Automobiles Citroën for all of its (and its Moderator’s) costs associated with considering such submissions from you.

By validating this form, an alert is automatically sent to the Moderator who will decide whether to keep or delete the Review or the response from the Dealership concerned or Automobiles Citroën. An email specifying the Moderator’s Review will be sent to the person who reported the abuse.

In addition, if the content is considered as abusive, the Review or the response from the Dealership or Automobiles Citroën, depending on the case, will be removed from the Site and an email will be sent to its author, informing them of the reason for deletion.

5.3 – Duration of publication of Reviews and Archiving

You cannot modify your Opinion once it has been published.

Reviews are published on the Site (and possibly the other aforementioned websites and mobile applications referred to in these General terms and conditions of use) for a duration of up to one year, unless you explicitly request your Review’s removal from the Site. To do so, you must send an email to the following address, rlc@citroen.com, specifying the date of your Review, or click on the link present in the publication confirmation email for your Review. In this case, you will not be able to submit a new Review for this same Customer experience.

Citroën Advisor Seller:

Reviews relating to Sales Persons who, in particular, are no longer active within a Citroën Dealer or no longer wish to participate in Citroën Automobiles' process to collect and publish the Reviews on the website, will be archived and therefore not available on the websites. The Review will however remain recorded in the database of Automobiles Citroën, please view our Privacy Policy for details.

ARTICLE 6 – RIGHT OF REPLY OF DEALERSHIPS AND OF AUTOMOBILES CITROËN

The Dealership has a right of reply to each Review published about them. As such, they can:

  • provide further details to the author of the Opinion or give their version of events if they disagree with the content of the published Opinion;
  • thank the author for their Opinion.

The Site publication of responses of the Dealership and Automobiles Citroën is subject to human moderation in a similar manner as referred to in respect of Opinions as referred to in article 4 above. Therefore, the response of the Dealership and Automobiles Citroën may be rejected by the Moderator for the reasons outlined in article 4.

A response from the Dealership and Automobiles Citroën which is approved to be published by Automobiles Citroën or the Moderator, will usually be done so within a timeframe of 7 calendar days from its submission.

Responses from Dealerships and Automobiles Citroën are published on the Site for the same duration as the Opinion to which they relate.

ARTICLE 7 - USE OF THE SITE & INTELLECTUAL PROPERTY RIGHTS

Automobiles Citroën has created the Site for the consumer use of Users. No commercial use of information presented within it, even partial, is allowed without the prior written agreement of Automobiles Citroën.

You accept that the Opinions are provided by either yourself or third party individuals, rather than by Automobiles Citroën, and you therefore agree that Automobiles Citroën does not accept any responsibility or liability for such Opinions. Furthermore, you agree that such Opinions are personal opinions of either yourself or third parties, and therefore not any form of assurances, warranties or representations. Consequently, you agree that you will not use the Opinions as the sole factor to make or refrain from making any decision, or choosing whether or not to do any act.

The content on the Site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain specialist advice in writing from Automobiles Citroën or the respective Dealership before taking, or refraining from, any action on the basis of the content on the Site.

Although Automobiles Citroën makes reasonable efforts to update the information on the Site, Automobiles Citroën makes no representations, warranties or guarantees, whether express or implied, that the content on the Site is accurate, complete or up to date.

You accept that numerous elements of the Site:

  • are protected by copyright legislation: these may be in particular photographs, articles, designs, animated sequences, digital audio or video recordings, etc.;
  • are protected by trademark legislation: these are in particular the "Citroën" and the "double chevron" (representing the Citroën logo) trademarks, the semi-figurative "PSA Peugeot Citroën" trademark, as well as the trademarks of the vehicle models.

The elements protected in this way belong to Automobiles Citroën, its subsidiaries and/or third parties who have authorised Automobiles Citroën to use them.

Consequently, any reproduction, representation, use, adaptation, modification, incorporation, translation or marketing, in part or in full, by means of any process, in any form and on whatever medium (paper, digital, etc.), of all or part of the Site by you is prohibited without the prior written authorisation of Automobiles Citroën.

ARTICLE 8 – PROTECTION OF PERSONAL DATA

8.1 - Personal data

Please note that our privacy policy also provides further information with regard to how we may use your personal data.

Any data which may be collected via the Site is collected by Automobiles Citroën for the processing of Opinions and may be used by the company, its subsidiaries, its commercial network, any company offering a service on behalf of Automobiles Citroën and/or any company belonging to the PSA Peugeot Citroën Group, for the purposes of sending commercial offers, surveys and analysis.

You are entitled to have access to, and request rectification of, personal data relating to you, as well as the right to object to the processing of such personal data, and in certain circumstances to have certain of your personal data which is held by us to be deleted. These rights may be exercised by writing to us at Automobiles Citroën, service Relation Clientèle / Contacts Internet (Customer Relations / Internet Contact department), 7 rue Henri Sainte-Claire Deville Rueil-Malmaison (92500) or by email to rlc@citroen.com. These rights are only available in respect of your personal data which we hold or control.

Within the framework of its activity, Automobiles Citroën may need to send data collected to other countries, for one of the purposes for which the data was initially collected or for objectives to which the participants have subsequently consented. When this data is sent to a third-party country, Automobiles Citroën takes reasonable safeguards in accordance with data protection laws. The data is only sent to countries where an adequate level of data protection is assured. The data may be sent to countries which are not members of the European Union.

The Site is subject to a declaration with the CNIL regarding the processing of personal data implemented within the framework of a website. This is declaration n° 1756809, dated 04.04.2013.

Automobiles Citroën is committed to processing your personal data in accordance with the applicable data protection laws. WHAT ARE COOKIES? The CNIL defines cookies as “a small text file placed on your hard drive by the server of the website that you are visiting. It contains pieces of information, in particular:

THE DIFFERENT TYPES OF COOKIES USED The cookies in use on the Site are used in different ways:

ARTICLE 9 – LINKS

The implementation of a hypertext link towards the Site requires prior and written authorisation from Automobiles Citroën. Where any consent is provided to you by Automobiles Citroën: you must not establish a link in such a way as to suggest any form of association, approval or endorsement on Automobiles Citroën’s part where none exists; you must not establish a link to the Site in any website that is not owned by you; the Site must not be framed on any other site; you may not create a link to any part of the Site other than the home page.

Under no circumstances can Automobiles Citroën be held responsible for the content of websites to which the Site finds itself affiliated to by way of hypertext links or any other type of link. ARTICLE 10 – SECURITY

You agree, in your use of the Site, not to carry out any operation that is likely to result in the introduction of computer viruses into the Site or Automobiles Citroën’s or its third parties’ systems. You also will ensure that you do not undertake any other unreasonable action which is likely to result in IT or any other nature of faults, which could affect the operation of the Site or any server or service accessible through the Site. In particular, you agree to only make available, in the space constituted by the Site, information, data, documents and files which are reliable, inoffensive and not susceptible to affect the operation of the Site or any server or service accessible through the Site.

Consequently, you must not misuse the Site by introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site. You must not attack the Site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence and Automobiles Citroën will report any such breach to the relevant law enforcement authorities and Automobiles Citroën will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site will cease immediately.

Your use made of the Site or any server or service accessible through the Site must comply with the national and international laws and regulations currently in force, as well as the rights of third-parties, and must not negatively affect the reputation or brand of Automobiles Citroën in any way or form. In particular, you agree to indemnify Automobiles Citroën against any third-party action linked to the content of the information made available by you pursuant to the Site, in particular those resulting from an infringement of: any rights, intellectual property rights, public order, common decency, respect for privacy (image rights, etc.) or the penal provisions of current national and/or international rights. In this respect, you agree to indemnify Automobiles Citroën against any costs, charges and expenses that would be incurred as a result, including the fees and reasonable expenses of Automobiles Citroën’s legal advisors.

Although Automobiles Citroën uses reasonable anti-virus measures in respect of its systems and the Site, it does not provide any assurance that the Site will be secure or free from viruses, so you must ensure that you have reasonable anti-virus and security software on your computer systems and other devices which interact with the Site, as Automobiles Citroën cannot provide any assurance that the Site will be virus free. Consequently, there is always the risk of data loss and data corruption on your devices and other equipment which you use with the Site. Therefore, Automobiles Citroën will not be liable to you for any viruses, or any data which you lose or which is corrupted resulting from the use of the Site. You must therefore have a good daily back up of your software, files and data in place, in case any of your data becomes lost or corrupted, or you are infected by a computer virus.

ARTICLE 11 – LIMITATION OF LIABILITY

You accept that the Site is being made available for personal, domestic, consumer use, and not for any of your business purposes. PSA Peugeot Citroën Group will not be held responsible for any damage directly or indirectly caused, such as, damage, loss of data or programs, or financial losses arising from the use of the Site or other websites which are linked to it.

The Site is accessible via the Internet network. In this respect, a reminder is issued that the Internet is an open and informal network, constituted by the interconnection on an international scale of IT networks. The management of the Internet is not subject to any central entity and each portion of this network belongs to an independent public or private body. Its operation is therefore based on the cooperation between the operators of the various networks, with no obligation of supply or of quality of supply between operators. The networks may have unequal transmission capacities and their own policies for use. No-one can guarantee the correct operation of the Internet as a whole. Therefore, Automobiles Citroën assumes neither responsibility for, nor a guarantee in the event of poor operation of, the Internet (transmissions delay or any other malfunction).

As Automobiles Citroën is not charging for access to the Site, Automobiles Citroën is not providing any assurances about the uptime or availability of the Site. Furthermore, you accept that there may be times when there might be outages in the Site’s availability.

You acknowledge that transmission of data using the internet is not guaranteed to be secure, so please bear this in mind when using any of the functionality of the Site.

Automobiles Citroën will not be held responsible by you for any losses resulting from damage, infection or corruption caused to your devices, including without limitation, any loss of data or software, or financial losses arising from the use of the Site.

Automobiles Citroën is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen, or if at the time the contract was made, both Automobiles Citroën and you knew it might happen.

Automobiles Citroën is not liable for your business losses. Automobiles Citroën only makes available the Site and associated services for personal, domestic, consumer use. Consequently, Automobiles Citroën will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

If Automobiles Citroën or the PSA Peugeot Citroën Group is found liable for any loss which is not lawfully excluded or limited, then where it is lawful for PSA Peugeot Citroën Group to limit its liability to you, it limits its liability to a total of £10 (ten pounds), to reflect that this Site is being provided on a free of charge basis to you. If you feel that your use of the Site may result in you losing more than this amount, then you must not use this Site.

The PSA Peugeot Citroën Group does not, by way of anything stated in the General terms and conditions of use or otherwise, exclude or limit in any way its liability to you where it would be unlawful to do so. Consequently, it does not exclude or limit liability for: death or personal injury caused by its negligence or the negligence of its employees, agents or subcontractors; fraud or fraudulent misrepresentation; or breach of your legal rights in relation to the Site where such losses are not permitted to be excluded or limited at law.

ARTICLE 12 – SUSPENSION OR UNINTERRUPTED OF ACCESS TO THE SITE

Automobiles Citroën is entitled to suspend or stop your access to the whole or part of the Site and its associated services at any time, temporarily or on a permanent basis, if:

  • it is no longer able to provide the Site or associated services; or
  • you fail to comply with the General terms and conditions of use; or
  • it is necessary to undertake any maintenance activities in respect of the Sites or its associated services or infrastructure; or
  • it is necessary to update the Site to reflect changes in relevant laws or regulatory requirements.

Automobiles Citroën does not charge for access to the Site. Therefore, Automobiles Citroën does not guarantee that the Site, or any content on it, will always be available or be uninterrupted. Automobiles Citroën may suspend or withdraw or restrict the availability of all or any part of the Site for business and operational reasons. Automobiles Citroën will try to give you reasonable notice of any material suspension or withdrawal.

ARTICLE 13 – APPLICABLE LAW

These General terms and conditions of use are governed by English law and you can bring legal proceedings in respect of the Site and the General terms and conditions of use, in the English courts.

ARTICLE 14 – UPDATES TO THE SITE & GENERAL TERMS AND CONDITIONS OF USE

Automobiles Citroën may issue updates to the Site from time to time. Such updates may contain enhancements to functionality, performance, compatibility, reliability, quality or security.

Automobiles Citroën may also change the General terms and conditions of use and Automobiles Citroën’s privacy policy as it applies to the Site. Such changes may be made for reasons which may include: changes in the features or functionality of the Site; compliance with laws; or changes in Automobiles Citroën’s operating model. If you do not wish to accept the updated terms, then you are not granted a licence to use the Site or its services.

Automobiles Citroën therefore reserves the right to amend and update, the General terms and conditions of use and any elements presented on the Site, for any reason, including to reflect changes to its products, services, Users' needs and its business priorities. Automobiles Citroën will try to give you reasonable notice of any major changes either via the Site or by email.

You must therefore consult the General terms and conditions of use every time you intend on using the Site (you will know that the General terms and conditions of use have been updated, if the version date at the start of these terms and conditions has been updated). You are considered to have accepted the latest version of the General terms and conditions of use every time you use the Site.

ARTICLE 15 – ADDITIONAL TERMS

Automobiles Citroën may transfer this contract to someone else. Automobiles Citroën may transfer its rights and obligations under the General terms and conditions of use to another organisation (but this will not affect your rights or obligations owed to you). Automobiles Citroën will always inform you in advance of the transfer if this happens (either by way of a general notice on the Site or by email).

You may not transfer your rights to someone else.

This contract is between you and Automobiles Citroën. No other person or party shall have any rights to enforce any of its terms (although the exclusions and limitations of liability will also apply for the benefit of PSA Peugeot Citroën Group, but such third parties’ consent will not be required to any changes, termination or other rights in relation to this contract).

Even if Automobiles Citroën delays in enforcing this contract, Automobiles Citroën can still enforce it later. If Automobiles Citroën does not insist immediately that you do anything which you are required to do under these General terms and conditions of use, or if Automobiles Citroën delays in taking steps against you in respect of you breaking this contract, that will not mean that you do not have to do those things, and it will not prevent Automobiles Citroën taking steps against you at a later date.
